The Delhi High Court on Monday overturned a CIC directive that had asked CBSE to allow inspection of former Union Minister Smriti Irani’s Class 10 and 12 records. The RTI plea was filed by Mohd. Naushadudin seeking details of her educational qualifications.

Justice Sachin Datta held that the Right to Information under Section 3 of the RTI Act is not absolute and is subject to exemptions under Section 8(1). He emphasized that personal information, protected under Section 8(1)(j), does not lose its safeguard merely because some details may have been made public earlier.
